Market Smart 360 Billing Policy

The following Terms of Use constitute AdTrak 360 LLC's ("Market Smart 360") Billing Policy and apply to ALL Market Smart 360 customers:

1. Payments.
All charges are shown in U.S. Dollars. Payments are to be made in U.S. dollars and must be drawn from a U.S. bank. Market Smart 360 accepts the following types of payment:

  1. Credit Card (VISA, MasterCard, American Express, Discover)
  2. Bank Wire Transfer
  3. PayPal

All payments are due on the Account Statement Date. The Account Statement Date is the first of the month.

If you provide Market Smart 360 your credit card information, you authorize Market Smart 360 to automatically charge your credit or debit card for charges that apply to your account. Recurring charges will be posted to your credit card until such time that you cancel your account in accordance with Market Smart 360's Billing Policy. Charges subsequent to your initial order are subject to Section 2 below. You are responsible for directly updating, or notifying Market Smart 360, of any changes to your credit card (including, but not limited to card number, expiration date, billing address, or card status).

Customers not paying by credit card agree to make payment of their balance due within ten (10) days of the Account Statement Date.

Accounts that are thirty (30) days past due will be automatically suspended. All past due and unpaid balances are subject to collection. In the event of collection, you will be liable for costs of collection including attorney's fees, court costs, and collection agency fees.

2. Billing Cycles.

  1. 2.1 New Clients.
    • o Market Smart 360 offers two Billing Cycles for new customers depending on the date of activation (the "Plan Activation Date"). The Billing Cycle begins on the Plan Activation Date. If the Plan Activation Date is between the 1st and 15th day of the month, Market Smart 360 will prorate the license fees for the products for the month in which the Plan Activation Date occurred. If the Plan Activation Date occurs between the 16th day and the end of the month, Market Smart 360 will prorate the license fee for each product based on the mid-month date of the month in which the Plan Activation Date occurred.
  2. 2.2 Existing Clients.
    1. 1. Adding a New Product to Subscription. If you add a new product to your subscription between the 1st and 15th day of the month, Market Smart 360 will prorate the license fees for the new product for the month in which the new product was added. If you add a product between the 16th day and the end of the month, the license fee for the product will be prorated based on the mid-month date of the month in which the product was added.
    2. 2. Upgrading a Product or Plan. If you decide to upgrade a product to your subscription, Market Smart 360 will prorate your account, regardless of the account type, or time of the month in which the upgrade occurred. The next billing cycle will reflect the prorated fee for the new rare plan or product, as well as the full month fee for the new rate plan.
    3. 3. Downgrading a Product. You have the option to downgrade from any Product or Plan. Should you downgrade, you will have access to a pre-downgraded rate plan until the next billing cycle. The next bill cycle will reflect the fee for the downgraded Product or Plan.
    4. 4. Removing a Product. If you choose to remove a Product, you will have access to the Product until the next billing cycle. The next billing cycle will reflect the changed fees due to the product removal.

3. Account Renewals.
In order to insure uninterrupted service to your subscription, all plans will automatically renew at the end of the plan's Billing Cycle. Plan renewal charges are based on the prevailing rate on the date of renewal according to the products selected. Plans are renewed for the same billing cycle. If you wish to cancel your plan before plan renewal, please refer to the Cancellation section below.

4. Statements.
Market Smart 360 emails invoices or statements.

5. Cancellations.
Cancellations may occur at any time. Please be aware that there are no pro-rated refunds after the first 30 days of service.

In order to cancel your plan, you must contact Market Smart 360 Customer Relations, Monday through Friday, 8:30am to 5:30pm Central Time, at (866) 747-9484 or by email at info@adtrak360.com.

Market Smart 360 does not monitor, and will not automatically cancel, plans for problems related to non-usage, your ISP, or any other secondary issues not directly related to Market Smart 360's services. Cancellation of your plan does not relieve you from paying any outstanding balance owed on the account. Market Smart 360 reserves the right to cancel any account, at any time, without notice, for any reason Market Smart 360 considers appropriate.

Plans will automatically renew until a plan is cancelled. For changes to products associated with your service, please see Section 2 above.

6. Refund Policy.
Plans and products that Market Smart 360 deems eligible for a refund will be issued to the method of original payment.

7. Billing Policy and Price Changes.
Market Smart 360 policies and prices are subject to change without notice. Any price changes become effective in the next billing cycle. Please review this policy periodically.
